2. Description of Service

PicBine is an AI-powered photo combining application that allows users to:

• Generate Creative Scenes: Create fantasy scenarios, travel destinations, and creative compositions
• Use Templates: Access pre-made scene templates or create custom scenes using text prompts
• Save and Share: Save high-quality combined images and share them with friends or on social media

3. User Accounts and Registration

• Account Creation: You may create an account using OAuth providers (Google, Apple) or as a guest user
• Account Security: You are responsible for maintaining the confidentiality of your account credentials
• Accurate Information: You agree to provide accurate and current information during registration
• Age Requirement: You must be at least 13 years old to use PicBine. Users under 18 should have parental supervision when uploading photos of people

4. Acceptable Use and User Responsibilities

4.1 Permitted Uses

• Create imaginative and creative photo combinations for personal use
• Generate fun and artistic content for social sharing
• Use the App for entertainment and creative expression
• Share generated images with proper attribution when required

4.2 Photo Upload Responsibilities

• Consent Required: You must have explicit consent from all people whose photos you upload to PicBine
• Own Photos: Only upload photos you own or have permission to use
• No Unauthorized Images: Do not upload photos of people without their knowledge or consent

4.3 Prohibited Uses

• Inappropriate Content: Creating sexually explicit, violent, or otherwise inappropriate combined images
• Deepfakes or Deception: Using combined images to deceive others or create misleading content
• Celebrity or Public Figures: Using photos of celebrities or public figures without authorization
• Illegal Activities: Any use that violates local, state, federal, or international laws
• Identity Theft: Creating images to impersonate or misrepresent individuals
• Commercial Misuse: Using generated images for unauthorized commercial purposes without proper rights

5. In-App Purchases and Subscription Terms

5.1 Generation Credits

PicBine operates on a generation credit system. Available purchase options:

• 5 Generations: $1.49 - Perfect for trying the app
• 10 Generations: $2.69 - Popular choice for casual use
• 20 Generations: $4.99 - Best value for active users

5.2 Purchase Terms

• Payment Processing: All purchases are processed through Apple App Store or Google Play Store
• Consumable Credits: Generation credits are consumed with each photo combination and cannot be refunded once used
• No Expiration: Purchased generation credits do not expire and remain in your account until used
• Account Binding: Credits are tied to your account and cannot be transferred between accounts
• Pricing Changes: We reserve the right to modify pricing with notice to users

5.3 Refund Policy

• Unused Credits: Refunds may be available for unused generation credits within 14 days of purchase
• Technical Issues: Full refunds available if technical problems prevent credit usage

6.2 App Intellectual Property

• App Ownership: PicBine, its AI technology, and user interface are owned by Chiya Labs
• Trademarks: PicBine and associated logos are trademarks of Chiya Labs
• No License: These Terms do not grant you any license to our intellectual property beyond using the App

6.3 AI-Generated Content

• Derivative Works: Combined images are derivative works based on your original uploaded photos
• Commercial Use: You may use generated images for personal and commercial purposes, subject to consent and rights in original photos
• Attribution: While not required, attribution to PicBine is appreciated when sharing generated content
• Third-Party Rights: Ensure any commercial use respects the rights of people appearing in generated images

7. Privacy and Data Protection

Your privacy is important to us. Our processing of facial images and personal data is governed by our Privacy Policy, which explains:

8.2 Content Disclaimers

• AI Accuracy: We do not guarantee the accuracy or realism of AI-generated combined images
• Unexpected Results: AI may occasionally produce unexpected or undesired results
• No Endorsement: Generated images do not constitute our endorsement of any activities, locations, or scenarios depicted
• User Responsibility: Users are responsible for how they use and share generated content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHIYA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF PICBINE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

10.1 Termination by You

• Account Deletion: You may delete your account at any time through app settings
• Data Deletion: Upon account deletion, your uploaded images and generated content will be deleted according to our Privacy Policy
• Unused Credits: Unused generation credits are forfeited upon account deletion

10.2 Termination by Us

• Violation of Terms: We may suspend or terminate your account for violation of these Terms
• Inappropriate Use: Accounts may be terminated for harassment, non-consensual content, or other prohibited uses
• Notice: We will provide reasonable notice of termination when possible
• Effect of Termination: Upon termination, your right to use PicBine ceases immediately
