Upscaly - AI photo enhancement app

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Upscaly mobile application (the "App"), provided by Chiya Labs ("we," "our," or "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. The Service

Upscaly enhances and upscales photos you choose, using artificial intelligence to restore detail, improve lighting, and increase resolution. You do not need an account to use the App. Results depend on the input photo and the AI model, and are provided on a best-effort basis.

3. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use the App, and old enough to form a binding agreement. By using the App you confirm that you meet these requirements.

4. Your Content and Responsibilities

• Ownership: You keep all rights to the photos you submit. We claim no ownership of your images or your enhanced results.
• Permission: You must have the right to use and enhance any photo you submit. Do not upload photos of other people without their consent, and do not upload images you do not have the rights to.
• License to process: You grant us a limited license to process your submitted photo solely to generate and return the enhanced result. We do not retain your photos after processing.

5. Acceptable Use

You agree not to use the App to:

• Upload content that is illegal, sexually explicit involving minors, or that infringes the rights of others.
• Create misleading, deceptive, or harmful imagery, including impersonation or non-consensual depictions of real people.
• Reverse engineer, disrupt, overload, or attempt to gain unauthorized access to the App or its systems.
• Use the App in violation of any applicable law or the App Store terms.

6. Credits and Purchases

• Consumable credits: Enhancements are paid for with credits sold as consumable In-App Purchases through Apple. Each enhancement uses credits as described in the App.
• Billing: Purchases are processed by Apple and are subject to Apple's terms. Prices are shown in the App before you buy.
• Consumables: Consumed credits are not refundable once used. Refund requests for purchases are handled by Apple under its App Store refund policy.
• Device storage: Because credits are stored on your device, deleting the App may remove your remaining balance.

7. Intellectual Property

The App, including its name, design, and software, is owned by Chiya Labs and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding. Your rights to your own photos and results are described in Section 4.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that enhancements will meet your expectations, that the App will be uninterrupted or error free, or that results will be accurate for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Chiya Labs will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the App at any time by deleting it. We may suspend or limit access to the App if you violate these Terms or misuse the service.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the updated Terms. The Last Updated date above shows the current version.

12. Governing Law

These Terms are governed by the laws applicable where Chiya Labs operates, without regard to conflict of law rules. Nothing in these Terms limits any consumer rights that cannot be waived under your local law.
