Upscaly - AI photo enhancement app

1. Introduction

Welcome to Upscaly ("we," "our," or "us"), a product of Chiya Labs. This Privacy Policy explains how we handle information when you use our mobile application Upscaly (the "App"). Upscaly enhances and upscales photos you choose, using artificial intelligence to restore detail, improve lighting, and increase resolution.

2. Information We Collect

2.1 Photos You Choose to Enhance

When you select a photo to enhance, the image is sent from your device to our processing service over an encrypted connection so it can be enhanced. This is the only image data we handle, and only for the purpose of returning an enhanced version to you. We do not browse or access your photo library. You choose each photo individually.

2.2 Purchases

Upscaly sells consumable credit packs through Apple In-App Purchase. Apple processes the payment. We do not receive or store your credit card number or billing details. Your credit balance is stored locally on your device.

2.3 Automatically Collected Information

• Diagnostics: Basic crash and error information may be collected to keep the App working. This does not include your photos.
• Paywall and analytics: We use Superwall to display purchase offers. Superwall may collect device identifiers and usage events to show the right offer and measure conversions. It does not receive your photos.
• Device information: Device model, operating system version, and App version, used for compatibility and support.

2.4 Face Data

• What it is used for: Face data is processed only to produce the enhanced version of your photo, for example restoring facial detail, texture, and lighting. It is used for nothing else.
• No identification or biometrics: We do not use face data for recognition, identity verification, authentication, or demographic profiling. We do not create, store, or share a faceprint or any biometric template.
• No tracking: Face data is never used to track you across apps or websites, and it is not linked to an identity because the App has no accounts.
• Not retained by us: Face data exists only inside the photo while it is being enhanced. Once the enhanced image is returned, the submitted photo is discarded by our service and is not stored on our servers.
• Where it is processed: The photo is processed by our AI provider (see Section 5) solely to generate the enhanced result, and is not retained by that provider for its own purposes.

3. How We Use Your Information

• Enhancing photos: To process the photo you submit and return an enhanced version.
• Purchases: To grant the credits you buy and let you spend them.
• Reliability: To diagnose crashes and improve stability.
• Support: To respond when you contact us.

4. Data Storage and Retention

• On your device: Your enhanced photos and history are stored only on your device. If you delete the App, they are deleted with it. To keep an enhanced photo, save it to your Photos library.
• On our servers: We do not store your photos. A submitted image is held only in memory for the seconds it takes to enhance it, then discarded.
• Credits: Your credit balance is stored locally on your device.

5. Data Sharing and Disclosure

We work with a small number of providers to run the App:

• AI processing (OpenRouter and Google): The photo you submit is sent through OpenRouter to a Google Gemini image model to generate the enhanced result. The image is processed only to produce your enhanced photo and is not retained for the provider's own purposes.
• Apple: Handles In-App Purchases and payment processing.
• Superwall: Presents purchase offers and measures conversions. It receives usage and device data, not your photos.

6. Your Privacy Choices

• Delete your data: Because history lives on your device, deleting a photo in the App or deleting the App removes it. There is no server-side account to erase.
• Control what you submit: You decide which photos to enhance. Nothing is processed unless you choose it.

7. Children's Privacy

Upscaly is not directed to children under 13, and we do not knowingly collect information from them. If you believe a child has provided us information, contact us and we will address it.

8. Security

Photos are transmitted over encrypted HTTPS connections. Because we do not retain your images and the App has no accounts, there is very little personal data to secure in the first place.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by the Last Updated date above and, where appropriate, noted in the App.
